Terms of Service

Welcome to CuePilates™. By accessing or using the CuePilates™ platform (the “Service”), you agree to be bound by these Terms of Service (“Terms”). Please read them carefully before creating an account or using any features of the Service.
CuePilates™ is operated by CuePilates.Fit (“we,” “us,” or “our”). If you do not agree to these Terms, do not access or use the Service.
1. Eligibility
CuePilates™ is intended for licensed Pilates instructors and individuals currently enrolled in an accredited Pilates instructor training program. By creating an account, you represent and warrant that:
- You hold a current, valid Pilates instructor certification from a recognized certification body (such as PMA, BASI, STOTT, Balanced Body, Power Pilates, or equivalent), or are actively enrolled in an accredited Pilates instructor training program
- You are at least 18 years of age
- You will use the Service solely for professional or training purposes related to Pilates instruction
- All information you provide during registration is accurate and current
Reference to any certification organizations listed above does not imply endorsement of or affiliation with CuePilates.Fit by those organizations.
CuePilates.Fit does not independently verify instructor credentials or training enrollment. By creating an account, you accept full responsibility for the accuracy of your representations. As part of the account creation process, you will be presented with and must agree to an additional professional disclaimer confirming your status. That disclaimer is incorporated into and forms part of these Terms. We reserve the right to suspend or terminate accounts of users who provide false information regarding their credentials.
2. Account Registration & Security
To access the Service, you must create an account. You are responsible for maintaining the confidentiality of your account credentials and for all activity that occurs under your account. You agree to notify us immediately of any unauthorized use of your account at hello@cuepilates.fit.
We reserve the right to refuse service, terminate accounts, or remove content at our sole discretion.
3. Subscription & Payment Terms
3.1 Paid Plans
Access to CuePilates™ requires a paid subscription. Subscription fees, billing cycles, and plan details are displayed on our pricing page. All fees are stated in U.S. dollars.
3.2 Billing
By subscribing, you authorize us to charge your payment method on a recurring basis (monthly or annually, depending on your selected plan) until you cancel. Payments are processed securely through Stripe. We do not store your payment card information directly.
3.3 Free Trials
If we offer a free trial, your subscription will automatically convert to a paid plan at the end of the trial period unless you cancel before the trial ends.
3.4 Cancellation & Refunds
You may cancel your subscription at any time through your account settings. Cancellation takes effect at the end of your current billing period — you will retain access to the Service through that date. We do not offer prorated refunds for partial billing periods, except where required by applicable law.
3.5 Price Changes
We reserve the right to change subscription pricing at any time. We will provide at least 30 days’ notice of any price increases by email or through the Service. Continued use after the effective date of a price change constitutes your acceptance of the new pricing.
4. Special Populations
Class plans generated for special populations — including but not limited to Pregnancy/Prenatal, Seniors, Geriatric/Elderly, Osteoporosis, Knee, Hip, and Shoulder conditions — are among the highest-risk content generated by the Platform. By selecting a special population and generating a plan, you expressly acknowledge and agree to all of the following:
- Certification required. You hold a recognized certification or specialization in the relevant population, or are working under the direct supervision of a certified specialist. CuePilates does not verify this.
- AI limitations. AI-generated plans for special populations may contain suggestions that are medically inappropriate, contraindicated, or directly contrary to recommendations made by a client’s physician, physical therapist, midwife, or other licensed healthcare provider. CuePilates™ has no knowledge of your client’s individual medical history, current treatment plan, surgical history, medications, or healthcare provider instructions.
- Healthcare provider instructions take absolute precedence. If a client’s healthcare provider has issued specific movement restrictions, contraindications, or precautions, those instructions override any plan generated by CuePilates™ without exception. It is your sole professional responsibility to obtain and review any relevant medical clearance or restrictions before using a generated plan.
- You must review every plan before teaching it. Do not use any AI-generated special populations plan without independently verifying that every exercise, spring setting, position, and modification is appropriate for your specific client’s condition, stage, and healthcare provider guidance.
- No medical advice. Nothing generated by CuePilates™ constitutes medical advice, physical therapy guidance, obstetric guidance, or clinical recommendation of any kind.
CuePilates expressly disclaims all liability for any injury, adverse outcome, medical complication, or harm — including but not limited to injury to a pregnant client or fetus, post-surgical complication, fall, fracture, or aggravation of a pre-existing condition — resulting from the use of any special populations plan generated by the Platform. You assume full professional, ethical, and legal responsibility for every decision made in the teaching environment.
5. AI-Generated Content Disclaimer
CuePilates™ uses artificial intelligence, including the Claude API by Anthropic, to generate class plans, cues, sequences, and other instructional content (“AI Content”). You acknowledge and agree that:
- AI Content is generated automatically and may not be perfectly tailored to every client’s needs, fitness level, or medical condition. You are responsible for reviewing all AI Content before use.
- AI Content does not constitute medical, physical therapy, or clinical advice. It is intended solely as a professional planning aid for qualified Pilates instructors.
- You assume full professional and legal responsibility for evaluating, adapting, and delivering any AI Content to your clients. CuePilates™ is a tool to support your expertise — not replace it.
- AI Content may occasionally contain errors, omissions, or inappropriate suggestions. Always apply your professional judgment before using any generated content in a class setting.
- We make no guarantees regarding the accuracy, completeness, or fitness for a particular purpose of any AI Content.
6. Intellectual Property
6.1 Our Content
The CuePilates™ platform, including its design, software, branding, and any content we create or provide (excluding AI Content generated at your direction), is owned by or licensed to us and is protected by copyright, trademark, and other intellectual property laws. The CuePilates™ name and logo are trademarks of CuePilates.Fit. You may not use our trademarks without prior written permission.
6.2 Your Content
You retain ownership of any original content you upload or create within the Service (“User Content”). By submitting User Content, you grant us a limited, non-exclusive, royalty-free license to store, display, and process your User Content solely to provide and improve the Service.
6.3 AI-Generated Output Ownership
Class plans, cue sequences, and other outputs generated by the AI at your direction are provided to you for your professional use. We do not claim ownership of these outputs. However, because AI outputs may be similar across users, we cannot guarantee exclusivity of any AI-generated content.
6.4 Restrictions
You may not copy, resell, sublicense, or redistribute the CuePilates™ platform, its features, or any underlying technology without our express written consent.
7. Data Privacy
We are committed to protecting your personal information. Our collection and use of personal data is governed by our Privacy Policy, which is incorporated into these Terms by reference.
In brief, we collect information you provide (such as your name, email, and professional details), usage data, and information necessary to process payments. We do not sell your personal data to third parties.
By using the Service, you consent to our data practices as described in the Privacy Policy. If you are located in a jurisdiction with specific data protection laws (such as the CCPA or GDPR), additional rights may apply.
8. Acceptable Use
You agree not to use CuePilates™ to:
- Violate any applicable laws or regulations
- Infringe upon the intellectual property rights of any third party
- Introduce malware, viruses, or any harmful code
- Reverse engineer, decompile, or attempt to extract the source code of the Service
- Share your account credentials with others or allow unauthorized access to your account
- Use the Service for any purpose other than professional Pilates instruction planning
- Systematically scrape, harvest, or extract data from the Service
9. Disclaimer of Warranties
The Service is provided “as is” and “as available” without warranties of any kind, express or implied. To the fullest extent permitted by law, we disclaim all warranties, including implied warranties of merchantability, fitness for a particular purpose, and non-infringement. We do not warrant that the Service will be uninterrupted, error-free, or free of harmful components.
10. Limitation of Liability
To the fullest extent permitted by applicable law, we shall not be liable for any indirect, incidental, special, consequential, or punitive damages, or any loss of profits, data, or goodwill, arising out of or in connection with your use of the Service. Our total liability to you for any claims arising under these Terms shall not exceed the amount you paid to us in the three (3) months preceding the claim.
11. Indemnification
You agree to indemnify and hold harmless CuePilates.Fit, its owner, and any service providers from and against any claims, liabilities, damages, losses, and expenses (including reasonable legal fees) arising out of or in any way connected with: (a) your use of the Service; (b) your User Content; (c) your violation of these Terms; or (d) any harm caused to your clients as a result of your use of AI Content.
12. Modifications to the Service & Terms
We reserve the right to modify or discontinue the Service (or any part thereof) at any time, with or without notice. We also reserve the right to update these Terms at any time. When we make material changes, we will notify you via email or a prominent notice within the Service. Your continued use of the Service after the effective date of updated Terms constitutes your acceptance of the changes.
13. Termination
We may suspend or terminate your account at any time for any reason, including if we believe you have violated these Terms. Upon termination, your right to access the Service will immediately cease. Provisions of these Terms that by their nature should survive termination shall survive, including intellectual property rights, disclaimers, and limitations of liability.
14. Governing Law & Dispute Resolution
These Terms shall be governed by the laws of the state in which CuePilates™ operates, without regard to its conflict of law provisions. Any disputes arising under these Terms shall first be attempted to be resolved through good-faith negotiation. If not resolved within 30 days, disputes shall be submitted to binding arbitration in accordance with the rules of the American Arbitration Association.
